General Terms

All products sold by IMMERSION DIGITAL, LLC are brand new and are manufactured to meet the highest industry standards. All prices and specifications are subject to change without notice. Any discrepancy, including wrong items or missing items, should be reported to IMMERSION DIGITAL, LLC within 24 hours. All packages will be shipped the following business day, excluding holidays. Because of the nature of the Internet, online ordering your purchase from IMMERSION DIGITAL, LLC acknowledges that you have read and agree to these terms and conditions. All brands and product names mentioned are trademarks and/or registered trademarks of their respective holders.

ID warrants that it will make reasonable efforts to correct material defects (as defined at ID’s sole discretion, “Material Defects”) in the Licensed Application that ID becomes aware of.  You may have to re-install an updated version of the Licensed Application once ID has corrected the Material Defect.  ID DOES NOT WARRANT THAT IT WILL CORRECT ALL DEFECTS, AND TO THE MAXIMUM EXTENT ALLOWED BY LAW, MAKES NO OTHER WARRANTY REGARDING THE LICENSED APPLICATION.

For customers in the United States who purchase a “boxed” copy of GLO Licensed Application, ID will replace the disc containing a Material Defect if: (1) You contact ID within thirty (30) days of purchase; (2) ID is unsuccessful in correcting the Material Defect; and, (3) ID determines at its sole discretion that the disc is defective.

Software RMA Policy

We can only accept unopened boxed software for return within 30 days of the purchase date. All returned products must be accompanied by a Return Merchandise Authorization (RMA) number. We do not accept returns without an RMA.

• Full name of purchaser (i.e., name of buyer)
• Date of Purchase
• Where your purchase was made (i.e., getglobible.com or Amazon.com)
• Email address used to place order (i.e., johndoe@gmail.com)
• Reason for requesting a return

Once you have an RMA, ship the product back to us. Make sure you include the original packing slip. You'll need to cover the cost of shipping, unless given alternative instruction from an authorized Returns Representative. Please use a shipping company that can track packages. We are not responsible for lost or stolen merchandise.
When your return has been received and processed, we will credit your account less shipping or ship you a new copy of your software.

Disclaimer of Warranties. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION, GLO STORE, AND CONTENT (AS DEFINED ABOVE) IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. EXCEPT FOR THE LIMITED WARRANTY SET FORTH ABOVE AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION, GLO STORE, AND CONTENT ARE PROVIDED "AS IS", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND ID AND ID’S LICENSORS (COLLECTIVELY REFERRED TO AS "ID" FOR THE PURPOSES OF SECTIONS 10 AND 11) HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION, GLO STORE, AND CONTENT, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. ID DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE LICENSED APPLICATION, GLO STORE, OR CONTENT, THAT THE FUNCTIONS CONTAINED IN THE LICENSED APPLICATION, GLO STORE, OR CONTENT WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE LICENSED APPLICATION, GLO STORE, OR CONTENT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE LICENSED APPLICATION, GLO STORE, OR CONTENT WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY ID OR AN ID AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION, GLO STORE, OR CONTENT PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL ID BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE LICENSED APPLICATION, GLO STORE, OR CONTENT, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF ID HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall ID’s total liability to You for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the greater of the amount You paid for the Licensed Application (not including any additional Content from the GLO Store) or fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

Controlling Law and Severability. This License will be governed by and construed in accordance with the laws of the State of Florida, as applied to agreements entered into and to be performed entirely within Florida between Florida residents. This License shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this License shall continue in full force and effect.

Complete Agreement; Governing Language. This License constitutes the entire agreement between the parties with respect to the use of the Licensed Application licensed hereunder and supersedes all prior EULAs or prior or contemporaneous understandings regarding such subject matter, with the exception of any additional terms and conditions You are required to accept if You choose to use GLO Store which will govern your use of such store and any Content You license through that store. No amendment to or modification of this License will be binding unless in writing and signed by ID. Any translation of this License is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this License shall govern.
